1. Acceptance of Terms

By downloading, installing, accessing, or using Nymbo ("the App"), you confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to any part of these Terms, you must stop using the App and delete it from your device immediately. These Terms constitute a legally binding agreement between you and Nymbo.

2. Service Description

Nymbo fuses plant-care management with social networking, enabling users to track watering schedules, light exposure, and growth milestones, while sharing photos, tips, and experiences with a community of plant enthusiasts. Features may include personalized care reminders, plant identification, and interactive forums.

We may modify, update, or discontinue portions or all of the App at any time without prior notice. While we strive for high availability, we do not guarantee that the App will be error-free or uninterrupted.

3. User Responsibilities & Conduct

Age Rating: 18+ | This application is intended for users 18 years of age and older.

You must be at least 18 years old to use Nymbo. By creating an account or using the App, you represent and warrant that you meet this age requirement.

Prohibited Activities

You agree not to:

Use Nymbo for any unlawful purpose or in violation of any local, national, or international law;
Post or transmit any content that is abusive, harassing, defamatory, or otherwise objectionable;
Distribute malware, viruses, or any other harmful code;
Attempt to gain unauthorized access to accounts, servers, or networks connected to Nymbo;
Interfere with or disrupt the integrity or performance of the App;
Impersonate any person or entity, or falsely state or misrepresent your affiliation;
Collect or store personal data about other users without their express permission;
Use the App to promote, facilitate, or engage in any commercial activities without our prior written consent.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Intellectual Property Rights

All content, design, graphics, compilation, and other materials of Nymbo, including all copyrights, trademarks, trade secrets, patents, and other intellectual-property rights, are owned or licensed by Nymbo and protected by United States and international laws.

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the App strictly in accordance with these Terms. Except as expressly permitted, you may not:

Reproduce, modify, distribute, or create derivative works from any part of the App;
Reverse-engineer, decompile, disassemble, or attempt to extract the source code;
Use any robot, spider, crawler, scraper, or other automated means to access the App;
Remove, alter, or obscure any proprietary notices on the App.

5. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by applicable law, Nymbo disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nymbo makes no warranty that (a) the App will meet your requirements; (b) the App will be uninterrupted, timely, secure, or error-free; (c) the results obtained from the use of the App will be accurate or reliable; or (d) any errors will be corrected.

6. Limitation of Liability

To the maximum extent permitted by law, Nymbo, its directors, employees, partners, licensors, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to your access to or use of, or inability to access or use, the App, even if advised of the possibility of such damages.

In no event shall Nymbo's aggregate liability exceed the greater of (i) one hundred U.S. dollars (USD $100) or (ii) the amounts you have paid Nymbo in the twelve (12) months preceding the event giving rise to the liability.

7. Account Termination

We may, at our sole discretion, suspend, disable, or terminate your account or access to all or part of the App at any time, with or without notice, if we determine that you have violated these Terms or applicable law.

Upon termination, your right to use Nymbo will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including intellectual-property, warranty disclaimers, and limitations of liability.

You may delete your account at any time through the App's settings or by contacting support@nymbo.com.

8. Modifications to Terms

Nymbo reserves the right, at its sole discretion, to modify or replace any part of these Terms at any time. We will provide notice of material changes by posting the updated Terms within the App or by other reasonable means.

Your continued use of, or access to, the App following the posting of any changes constitutes acceptance of those changes. It is your responsibility to check these Terms periodically for changes.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict-of-law principles.

Any dispute arising out of or relating to these Terms or the App shall be resolved exclusively by binding arbitration administered by the American Arbitration Association in San Francisco, California, unless both parties agree otherwise in writing.
